1. Booking and Payment
– All photoshoots must be booked in advance. To confirm your booking, you need to select a date and time through my website or via personal communication (through social media or other channels).
-Before making a deposit, the client is required to review the full Terms and Conditions of my service. All conditions are posted on my website. When booking through the site, the client must check a box confirming that they have read and agreed to these conditions.
– If the booking is made through other communication channels, I will send the client a link to the Terms and Conditions. The client must provide written confirmation of their agreement (for example, by sending a message saying “Yes, I confirm”).
– The booking is considered complete only after receiving your written agreement to the terms and the deposit of 30% of the total amount. The deposit is made after agreeing on the time and date of the photoshoot. Payment is accepted via e-transfer or cash.
– If the photoshoot takes place in a studio, the client can choose and pay for the studio rental directly through the link I provide. If I book the studio, the client must first transfer the rental amount to me, and only after receiving payment will I proceed with the booking.
– The remaining balance is due immediately after the photoshoot. Accepted payment methods include electronic transfers or cash unless otherwise agreed upon.
2. Cancellation and Rescheduling
– If you need to cancel or reschedule the session, please inform me as soon as possible.
– For cancellations or rescheduling, the deposit of 30% of the total session fee is non-refundable as it covers the consultation and preparation work for the session.
– If you inform me on the day of the session that you cannot attend, I reserve the right to charge a penalty of 50% of the total session cost, as I have already spent time and resources preparing for the session.
– In case of emergencies, if you are unable to attend the photoshoot in the studio, please notify me and the studio as soon as possible. Keep in mind that each studio has its own cancellation and rescheduling policies. Some studios may allow you to reschedule for another date for a small fee, while others may not provide that option. If the studio does not offer rescheduling and does not refund the rental fee, the client is responsible for any lost money related to the studio booking. If the studio allows you to reschedule for another date but requires additional payment, the client is responsible for covering any extra costs related to rescheduling.
– In the event of an emergency on my end and I am unable to conduct the photoshoot, I will notify you as soon as possible. I am not responsible for any financial losses related to these circumstances. If the studio allows rescheduling but requires additional payment, I will cover part of the extra costs associated with rescheduling (for example, if the studio charges a small fee to change the date), but any significant expenses will be covered by you.
3. Gift Certificate Terms
– Gift certificates are non-refundable but may be transferred to another person only with prior written notification to the photographer. This is necessary to avoid misunderstandings and to confirm the transfer of the certificate.
– Gift certificates are valid for 2 months from the date of issue unless otherwise specified.
– Sessions must be booked within the validity period of the certificate. If the client is unable to use the certificate within the specified period, it will be considered their responsibility.
– However, in case of unforeseen circumstances, such as my relocation or other emergencies, I will notify clients in advance and am willing to discuss the possibility of extending the validity period of the certificate for a short time.
– If a client orders a gift certificate to be mailed, the shipping costs will be covered by the client.
4. Session Details
– The duration of the photoshoot, location, and other specific details will be agreed upon in advance.
– Please arrive on time for your session. Sessions that start late due to the client’s fault may be shortened or rescheduled at the photographer’s discretion.
– Any requests for specific poses, locations, or creative ideas should be communicated in advance or during the session.
– If the client wants additional shooting time during the photoshoot, the extension is possible for an additional fee.
5. Photo Delivery
– The photographer selects the best photos and sends the original images to the client via Google Drive for the client to choose a specific number of photos for editing, as specified in the package. All photos must be downloaded within 1 month, as they will be deleted after this period.
– Edited digital photos will be provided within 1-2 weeks after the session through Google Drive or another agreed-upon method. Delivery times may vary depending on the chosen package.
– Prints and other products (such as albums) may take longer, depending on the specific order, and an additional fee will be charged for these. However, in some wedding packages, a printed book is included at no additional cost as a gift.
– If a client orders printed photos or a photo book, the shipping costs will be covered by the client, unless the item is included as a complimentary gift in specific packages.
– The photographer reserves the right to select which images will be edited and provided.
6. Client Consent and Usage
– The photographer will seek the client’s consent to use images in their portfolio, marketing, or other promotional materials. Consent can be given either in written or verbal form (for example, in a message).
– Photographs will only be uploaded to the photographer’s website with the explicit permission of the client.
– Clients have the right to decline the use of their images for any promotional or marketing purposes.
– Comments from clients on the photographer’s website are not allowed.
7. Copyright
– All rights to the images remain with the photographer.
– Clients receive a limited license to use the edited photographs for personal purposes but cannot use them for commercial purposes without prior consent from the photographer.
– When publishing photographs on social media, clients are required to credit the photographer.
– Altering photographs (including applying filters and editing) is prohibited.
– Clients do not have the right to distribute or publish the original photographs on the internet or elsewhere without the explicit permission of the photographer.
– Original photographs are provided solely for selecting a specific number of images for editing and remain under the copyright of the photographer.
– The photographer reserves the right to use the images in their portfolio, advertising, and marketing but will seek the client’s consent before publication. In the event of a client’s refusal, the photographer respects their decision and does not publish the image.
8. Retouching and Editing
– Basic editing and retouching (such as color correction, exposure adjustment, and minor skin retouching) are included in the service up to the amount specified in your chosen package.
– Additional photo editing and retouching requests (such as extensive skin smoothing or object removal) will be charged separately.
9. Refunds
– Refunds are not offered for completed sessions unless there was a significant issue with the service provided.
– In case of dissatisfaction, we offer one round of revisions to the edited photos.
10. Behavior
– We strive to create a respectful, professional, and comfortable atmosphere during the session. Any inappropriate behavior from the client or from my side will result in the immediate termination of the session without a refund. The photographer reserves the right to refuse to conduct any session or project that may involve illegal or unethical content.
11. Liability
– The photographer is not responsible for any loss or damage to personal property during the session.
– The photographer is not liable for unforeseen circumstances that may affect the quality or completion of the session (such as equipment failure or weather conditions). In such cases, we will do our best to reschedule or offer alternative solutions.
12. Agreement to Terms
– When booking a session through the website, clients confirm their acceptance of the terms and conditions outlined in this document by checking the appropriate box on the website.
– If the booking is made through other communication channels, clients will be sent a link to the Terms and Conditions. The client must confirm their acceptance in writing (for example, by sending a message stating “Yes, I confirm”).
Both methods of confirmation are considered equivalent to signing a contract and indicate that both parties understand and accept the specific details, expectations, and responsibilities.
13. Transfer to Distant Locations
– If the photo shoot is held at a location outside the city or in a remote area, the client is responsible for organizing the transportation for the photographer and the team (if applicable). This may include either providing transportation or covering travel expenses.
